AN  ACT  to  amend  the  penal law, in relation to criminal mischief and related offenses
 
Became a law September 25, 2008, with the approval of the Governor.
Passed by a majority vote, three-fifths being present.
 
     The People of the State of New York, represented in Senate and  Assem-
   bly, do enact as follows:
 
     Section  1. The penal law is amended by adding a new section 145.13 to
   read as follows:
   § 145.13 Definitions.
     For the purposes of sections 145.00, 145.05, 145.10 and 145.12 of this
   article:
     "Property of another" shall include property jointly  or  co-owned  by
   another  person. It shall be no defense that one believes that he or she
   has a reasonable ground or right to damage such property because  he  or
   she  owns  such  property  along  with  another person unless such other
   person has given his or her consent to damage such property.
     § 2. This act shall take effect on the first of November next succeed-
   ing the date on which it shall have become a law.
 
   The Legislature of the STATE OF NEW YORK ss:
     Pursuant to the authority vested in us by section 70-b of  the  Public
   Officers  Law,  we  hereby  jointly  certify that this slip copy of this
